Car "Three Guarantees" is expected to be implemented during the legislative process
China is set to implement a "Three Guarantees" policy for automotive products this year, according to the Beijing Youth Daily. The Administration of Quality Supervision, Inspection and Quarantine (AQSIQ) announced that the draft regulations on the responsibility for repair, replacement, and return of household automobiles have completed all negotiations and demonstrations, and are now entering the legislative process.
The "Three Guarantees" system refers to the legal framework that allows consumers to request repairs, replacements, or returns for vehicles with quality issues. Under the proposed rules, the guarantees will be valid for two years or 40,000 kilometers, whichever comes first. During this period, if a vehicle has defects, consumers can claim their rights based on the three-guarantee certificate. If any damage occurs, sellers, manufacturers, and repairers will be legally responsible for compensation.
After two unsuccessful repairs, consumers can request a return from the dealer. Additionally, repairers must provide at least one free maintenance service during the guarantee period. This new regulation is expected to address long-standing consumer complaints about car quality and unresolved disputes.
In recent years, several high-profile cases, such as the "Bang Ben Incident" and the "Liu Guichen Incident," highlighted the challenges consumers faced when trying to resolve issues with their vehicles. With the growing number of cars in China, problems related to complaints, mediation, and compensation have become major concerns for car owners.
Experts believe that the introduction of the "Three Guarantees" system is a critical step in addressing these issues. Shi Yaodong from the State Council's Development Research Institute emphasized that compared to the recall system, implementing the Three Guarantees policy is the top priority in resolving current consumer complaints. He added that if properly executed, it could also help solve some of the bottlenecks in the existing recall system.
Wan Jiang from Yaw Resources Beijing also noted that while car recalls are complex and require long-term efforts, the Three Guarantees policy offers immediate practical value in handling consumer grievances. In addition to this, another important car-related policy is expected to be released this year, focusing on sensitive issues like additional charges during the purchase, use, and maintenance of vehicles. For the first time, it clearly states that consumers have the right to refuse to pay unreasonable extra fees.
