Car "Three Guarantees" is expected to be implemented during the legislative process
China is set to implement a "Three Guarantees" system for automobiles this year, marking a significant step forward in consumer protection. According to the Beijing Youth Daily, the Administration of Quality Supervision, Inspection and Quarantine (AQSIQ) confirmed that the draft regulations on the repair, replacement, and return of household automobile products have completed all necessary negotiations and demonstrations, and are now entering the legislative process.
The "Three Guarantees" system refers to the legal provisions ensuring that car buyers can get repairs, replacements, or refunds if their vehicles have quality issues within a specified period. The current draft sets the validity period at two years or 40,000 kilometers, whichever comes first. During this time, consumers with quality problems can claim their rights based on the Three Guarantees certificate. If any losses occur, sellers, manufacturers, and repairers will be legally responsible for compensation.
If a vehicle requires two repairs and still does not function properly, consumers can request a refund from the dealer. Additionally, repairers must provide at least one free maintenance service during the guarantee period. This move is expected to address long-standing issues where car complaints were often ignored or poorly handled.
Recently, two key regulations—on the responsibility of repairing, replacing, and returning automotive products, and on the recall of defective vehicles—were officially implemented. These measures are seen as major steps toward resolving consumer disputes. Under the Consumer Law, goods listed under the Three Guarantees have clear legal responsibilities and return conditions. However, cars have historically been excluded from this list, leading to confusion and difficulties in handling complaints.
In recent years, incidents like the "Bang Ben Case" and the "Liu Guichen Incident" highlighted the challenges faced by car consumers when their concerns were not properly addressed. With the number of vehicles in China increasing rapidly, complaints, mediation difficulties, and compensation issues have become major pain points for car owners.
Shi Yaodong, a researcher from the State Council's Development Research Institute, emphasized that compared to the "recall" system, implementing the "Three Guarantees" policy is the top priority in resolving current consumer complaints. He added that if the Three Guarantees system is effectively implemented, many of the bottlenecks in the recall process could also be resolved.
Wan Jiang from the Yaw Resources Beijing office believes that while car recalls are a complex and large-scale project, the Three Guarantees system has practical value in addressing consumer grievances. He also mentioned that another important car consumption policy related to consumer interests is expected to be introduced this year. This regulation will address sensitive issues such as additional fees that have long been a concern for car buyers. For the first time, it clearly states that consumers have the right to refuse to pay unreasonable extra charges during the purchase, use, and maintenance of vehicles.
